Welcome to Let's List It. By accessing or using our website, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, you may not use or access the Services.

2. Description of Services

Let's List It provides flat fee Multiple Listing Service (MLS) listing services for property owners looking to sell their properties. Our services include, but are not limited to:

  • Listing properties on the MLS and other real estate platforms
  • Providing property marketing materials
  • Facilitating communication between property sellers and potential buyers
  • Offering additional real estate services as described on our website

3. User Accounts

To access certain features of our Services, you may need to create an account. You are responsible for:

  • Providing accurate and complete account information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. Property Listings

When you submit a property listing through our Services, you represent and warrant that:

  • You have the legal right to sell or list the property
  • All information provided about the property is accurate and complete
  • The content of your listing complies with all applicable laws and regulations, including fair housing laws
  • You have obtained all necessary permissions for any images or content you provide

We reserve the right to remove or edit any property listings that violate these Terms or applicable laws.

5. Payment Terms

Payment for our Services is required in advance. By making a payment, you agree to:

  • Pay all fees and charges associated with your selected service package
  • Provide current, complete, and accurate billing information
  • Our Refund Policy, which is incorporated into these Terms by reference

We use third-party payment processors and do not store your payment information. All payment transactions are subject to the terms and privacy policies of our payment processors.

6. User Content

You retain ownership of any content you submit to our Services, including property descriptions, images, and other materials ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and promoting our Services.

You are solely responsible for your User Content and the consequences of posting or publishing it. We do not endorse any User Content or opinions expressed by users.

7. Prohibited Activities

When using our Services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Submit false or misleading information about properties
  • Use the Services to send unsolicited communications or spam
  • Attempt to gain unauthorized access to our systems or user accounts

The Services, including all content, features, and functionality, are owned by Let's List It or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or use any content from our Services without our prior written consent.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, error-free, or that defects will be corrected. We are not responsible for the accuracy or reliability of any information obtained through the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LET'S LIST IT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Let's List It, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Third-Party Links and Content

The Services may contain links to third-party websites or services that are not owned or controlled by Let's List It. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Let's List It shall not be responsible or liable for any damage or loss caused by your use of any such websites or services.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes to the Terms, we will provide notice through the Services or by other means. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the federal or state courts located in Harris County, Texas.

15. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
